Article 4. The emergence of the right to State protection The Law on State Protection of Persons Involved in Criminal Proceedings
1. If there is sufficient information about the threat of violence or other acts prohibited by criminal law against persons subject to State protection, the authorities ensuring the safety of protected persons are obliged, within their competence, to take State protection measures provided for by this Law.
2. In cases provided for by the laws of the Republic of Kazakhstan, the decision on the application of security measures against citizens who assist bodies engaged in operational search and counterintelligence activities, along with the body conducting criminal proceedings, in accordance with the procedure provided for by this Law, shall be taken by bodies engaged in operational search and counterintelligence activities.
The Law of the Republic of Kazakhstan dated July 5, 2000 No. 72.
This Law establishes a system of State measures to protect the life, health, property, legitimate rights, and interests of persons participating in criminal proceedings, their family members, and close relatives, and to ensure their safety in order to prevent unlawful interference in criminal proceedings.
